Car ECM Repair, LLC Terms of Service

Car ECM Repair, LLC is provided to all users/user subject to these Terms of Service. By using the Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must immediately cease using the Site. Car ECM Repair reserves the right to enforce these Terms through any lawful means, including civil litigation and referral to applicable authorities for criminal prosecution.

This is a legal agreement between you and Car ECM Repair. All users of Car ECM repair should carefully review these terms, as they contain important information about users’ legal rights and responsibilities.

These Terms may be supplemented by additional legal policies or procedures, which are incorporated herein by reference. In the event of any conflicts between these Terms and the additional policies, these Terms shall take precedence.
Unless explicitly stated otherwise, in-store credit will incur return fees if the unit is found to be free of defects, as determined solely by the Seller. NO replacements will be issued until the returned item has been received. 

  • By using the Service or the Site, you represent and warrant that you are fourteen (14) years of age or older and that you agree to comply with these Terms. By registering with the Site, you affirm that your registration follows all applicable laws, rules, and regulations. Car ECM Repair reserves the right to prevent or cancel a user’s registration for any reason. Membership on Car ECM Repair is void where prohibited by law.

 

  • The Buyer will not be reimbursed for any such expenses—NO EXCEPTIONS. The Buyer acknowledges and agrees that the Seller’s liability is limited to the purchase price of the item sold, and the Seller is not responsible for any damage or injury arising from any item(s) sold by any entity operated by Car ECM Repair, LLC. The Buyer hereby relinquishes any liability from the Seller for such claims now and in the future.

 

  • Any information provided to the site by users must be accurate, current, and complete. Impersonation of third parties or false identities is prohibited. Users are responsible for promptly updating their information and must maintain the security of their usernames, passwords, and other personally identifiable information. Users are accountable for all activities undertaken via their account.

 

  • Car ECM Repair mayrequire additional verification of a user’s identity or background information to continue accessing the site. Users shall provide additional information upon request.

 

  • The owner of a User Account is solely responsible for all activities occurring on the Site under that account.
        1. Users agree to maintain the confidentiality of their user account and password.
        2. Users are responsible for all activities occurring under their account, including any third-party use.
        3. Users will not permit unauthorized third parties to access the site via their account.
        4. Users acknowledge that Car ECM Repair is not liable for any loss that may arise from unauthorized use of their account or password.
        5. Users shall not use the site for any unlawful, fraudulent, or unauthorized purposes.
        6. Users agree to cooperate with any investigation by Car ECM Repair into fraudulent or unlawful activity.
        7. Users agree not to create obscene, defamatory, or hateful usernames.

 

  • Car ECM Repair reserves the right to suspend or terminate any User account for any reason. The Site may also prohibit a User from accessing any portion of the service at its discretion. Car ECM Repair reserves the right to cancel or disable accounts that have been dormant for more than 12 months.

 

  • Car ECM Repair maintains a separate Privacy Policy that describes the collection and use of information gathered on the site. Any personally identifiable information you submit for products or services will be handled according to the Car ECM Repair Privacy Policy. By accessing the Site, Users acknowledge and agree to this Privacy Policy.

 

  • The service and site are owned by Car ECM Repair. All aspects of the service and site, including but not limited to methods, processes, content, formats, and domain names, are the exclusive property of Car ECM Repair. Other rights, including inventions, trade secrets, patents, copyrights, trademarks, and other intellectual property rights, are owned solely by Car ECM Repair. No rights are conferred to users except as specifically stated herein.

 

  • Content provided by users for display on the service remains the property of the user or applicable third-party rights holder. By providing Content, Users grant Car ECM Repair a limited license to host, transmit, and display User Content. This limited license does not grant Car ECM Repair any rights in the User Content.

 

  • No User shall use the Site to infringe upon any copyrighted works, trademarks, trade secrets, or other intellectual property rights of any third party.

 

  • Users acknowledge that communications with Car ECM Repair, including but not limited to comments, suggestions, questions, and other information or communications about the Service, are not confidential. Such communications shall become the property of Car ECM Repair. In sending the Site any information or material, you grant Car ECM Repair an unrestricted, irrevocable license to copy, reproduce, publish, upload, post, transmit, distribute, publicly display, perform, modify, create derivative works from, and otherwise freely use such materials or information without User compensation or acknowledgment.

 

  • The Content appearing on Car ECM Repair may be subject to copyright protection. Applicable copyrights are the proprietary property of Car ECM Repair, its Users, its licensors, or other third parties, with all rights reserved.
  1. a- Content on Car ECM Repair may not be copied, reproduced, republished, uploaded, posted, transmitted, distributed, or otherwise used for the creation of derivative works without the express written consent of Car ECM Repair.
        b. Users are granted a non-exclusive, non-transferable, limited permission to access and display the Content appearing on Car ECM Repair on the User’s client for purposes of personal, non-commercial use of the Service, subject to these Terms. Users must retain all copyright, trademarks, and other intellectual property notices contained in content.
        c. Some Content appearing on Car ECM Repair, including but not limited to third-party content, software, and related resources, may be subject to their own terms, conditions, licenses, and notices. Such Content shall be governed by their own terms and conditions as may or may not be provided.
        d. All licenses provided to Users by Car ECM Repair are subject to revocation by the Service at any time without notice and with or without cause. Any use of the Service other than that specifically provided in these Terms or as expressly granted by Car ECM Repair is strictly prohibited and shall immediately terminate without notice any license granted by these Terms.

 

  • Trademarks, Service Marks, and Other Intellectual Property. Content appearing on Car ECM Repair may contain trademarks, service marks, trade names, and trade dress owned by Car ECM Repair. These marks and names are subject to applicable trademark laws in the United States and internationally and may not be used in connection with any service or product that is likely to violate applicable trademark laws unless such use is expressly granted by Car ECM Repair. Unless explicitly stated, nothing in these Terms shall be construed as a grant of intellectual property rights under any legal theory.

 

  • Third Party Content and Services. The Content available via the Service may include access to third-party sites, services, and content provided by other Users that are completely independent of Car ECM Repair.

 

  •     a. These third-party resources may include, but are not limited to, third-party websites, software, products, services, networks, and similar resources.
        b. Inclusion of third-party resources on Car ECM Repair does not imply endorsement or approval of any resource. Car ECM Repair does not investigate, review, monitor or otherwise regulate third-party resources that may appear on the Site, and the Service does not warrant the accuracy, completeness, or appropriateness of third-party resources appearing on the Site. Any User choosing to interact with a third-party resource appearing on Car ECM Repair is subject to the terms and conditions of that third-party resource.
        c. Users access third-party resources found on the Site at their own risk. Car ECM Repair urges Users to review the applicable terms and policies, including privacy and data gathering practices, of any third-party resource accessed from Car ECM Repair. All Users agree that Car ECM Repair shall not be responsible for any loss or damage of any sort incurred as the result of any dealings or transactions between Users or between a User and a third party.

 

  • User agrees to the following restrictions as a condition of employing the Service.

 

  •     a. No User shall attempt to circumvent the Site or its communications process by any means.
        b. No User shall engage in any activity that would be considered harassing to any other User.
        c. No User shall make any effort to obtain unauthorized access to any portion of the Site that is not intended for the User.
        d. No User shall make any communication to other Users related to any third-party economic interest, including, but not limited to, promotions of other websites, businesses, or interests.
        e. Members who initiate and receive services via Car ECM Repair do so entirely at their own risk.

    • Car ECM Repair reserves the right to alter these Terms at any time, with changes taking effect immediately upon publication. Although Car ECM Repair may inform Users of any modifications, it is the User’s responsibility to regularly review these Terms.

    • These Terms, along with any additional policies referenced herein, represent the complete agreement between Car ECM Repair and the User.

    • The failure of Car ECM Repair to address a breach of these Terms by a User does not forfeit the Site’s right to act regarding any future or similar breaches.
